AGREEMENT
These definitions should help you understand this policy. When we say “we,” “us,” “our,” and “Barre & Sculpt Club,” we are referring to Barre & Sculpt Club, Istanbul. We provide online platforms that you may use to access online barre, sculpt and fitness classes and related content (the “Services”).
When we say “client,” we are referring to the person or entity that is registered with us to use the Services.
When we say “you,” we are referring either to a client or to some other person who visits any of our Websites.
A “customer” is a person you contact through our Services, or a person who you might choose to contact at some point in the future through the use of our Services.
“Personal Information” means any information that identifies or can be used to identify you, directly or indirectly, including but not limited to first and last name, date of birth, email address, gender, occupation or other demographic information.
A “customer list” is a list of customers and all associated information related to those customers (for example, email addresses).
ACCEPTANCE OF TERMS
This Agreement sets forth legally binding terms for your use of Barre & Sculpt Club. By using Barre & Sculpt Club, you agree to be bound by this Agreement, whether you are a “Visitor” (which means that you simply browse Barre & Sculpt Club without access to content) or you are a “Member” (which means that you have registered as a user).
If you do not accept the terms of this Agreement, you must discontinue use of the Service immediately.
We may modify this Agreement from time to time, and such modification shall be effective upon its posting on www.barreandsculpt.co
. Your continued use after modifications signifies acceptance.
Please read this agreement carefully as it forms the legal relationship between us and provides important practical information regarding participation in classes.
By participating in online classes, you agree to the terms and conditions outlined here.
We are not medical professionals. If you have concerns about your health, consult a physician before participating.
By engaging in live or pre-recorded classes, you accept that participation is at your own risk and assume full responsibility for any injury.
You agree to exercise in a safe, obstacle-free area and wear appropriate clothing. Stop immediately if you feel dizzy or unwell.
PAYMENTS, CANCELLATIONS & REFUNDS
Memberships require upfront payment and activate only after full payment.
If you cancel, your subscription will terminate at the time of cancellation. Please cancel 1–2 days before renewal to ensure uninterrupted access.
All memberships once commenced are non-refundable. No refunds, transfers, suspensions or extensions are provided for unused portions due to illness, injury, relocation or other reasons.
Membership provides unlimited class access during the membership period.
Membership fees are automatically charged according to your billing cycle via www.barreandsculpt.co
unless cancelled before renewal.
Barre & Sculpt Club is not responsible for additional bank fees.
Fees may increase periodically.
Subscriptions are final. No refunds or exchanges are provided once purchased.
All memberships are non-transferable.
LIVE CLASSES
Classes take place according to the schedule published on www.barreandsculpt.co
. We reserve the right to modify or cancel live classes and will provide notice where possible.
Please ensure your contact details are up to date.
LIABILITY
Nothing limits liability for death or personal injury caused by negligence where such limitation is unlawful.
Services are provided with due care and skill. Beyond this, all warranties are excluded to the fullest extent permitted by law.
Total liability shall be limited to the total amount paid by you in the preceding 12 months.
We are not liable for indirect or consequential losses including loss of profits, business or data.
Liability provisions survive termination.
HEALTH DISCLAIMER
Physical exercise carries inherent risk.
You are advised to seek medical advice before beginning any program.
Barre & Sculpt Club is not suitable for pregnant individuals unless medically cleared.
All participation is voluntary and at your own risk.
You waive any claims against Barre & Sculpt Club, including instructors, affiliates, contractors and representatives.
MINORS
Content is not directed to individuals under 18 years of age. By registering, you confirm that you are 18 or older.
MEMBER ACCOUNT & SECURITY
You are responsible for maintaining confidentiality of your account and password.
Notify us immediately of unauthorized access.
We are not liable for loss resulting from failure to protect account details.
PROHIBITED CONDUCT
You agree not to upload or transmit content that:
Is unlawful, abusive, racist, defamatory or obscene
Violates intellectual property rights
Promotes illegal activity
Contains viruses or harmful code
Constitutes spam or unauthorized solicitation
Infringes privacy rights
Automated scraping or excessive system access is prohibited.
INTELLECTUAL PROPERTY
All materials on Barre & Sculpt Club — including videos, branding, graphics, text and software — are protected by intellectual property laws.
Content may only be streamed for personal, non-commercial use.
Downloading, copying, distributing or commercial use is strictly prohibited.
MEMBERSHIP TERMS
No sharing of login credentials is permitted. Excessive logins may result in termination without refund.
Memberships renew automatically until cancelled.
Price increases may occur.
DISCLAIMER OF WARRANTIES
Services are provided “AS IS” without warranties.
We are not liable for errors, interruptions, viruses, unauthorized access or third-party actions.
GOVERNING LAW
This Agreement is governed by the laws of Türkiye.
Istanbul (ÇaÄŸlayan) Courts have exclusive jurisdiction.
TERMINATION
We may terminate or suspend accounts at our discretion for violations.
You may cancel membership anytime; no refunds for current billing period.
PRIVACY POLICY
Our Privacy Policy is incorporated into this Agreement and available at www.barreandsculpt.co
.
INDEMNITY
You agree to indemnify and hold harmless Barre & Sculpt Club from claims arising from your use of the Service or breach of this Agreement.
MODIFICATION
We may modify or discontinue Services at any time without liability.
ENTIRE AGREEMENT
This Agreement, together with the Privacy Policy and other legal notices on www.barreandsculpt.co
, constitutes the entire agreement between you and Barre & Sculpt Club.
